Overview

FORCEBRANDS provides recruiting products and services tailored for the consumer products industry, including an online platform where employers and job seekers can post and search for employment opportunities. This Privacy Policy (“Policy”) describes how FORCEBRANDS collects and processes personal information when you interact with us through our products and services, whether through our online platform, various websites (www.forcebrands.com, www.bevforce.com, www.foodforce.com, www.beautyforce.com, and www.herbforce.com), applications, tools, forms, email, or in-person (our "Products and Services").

Your use of the FORCEBRANDS Products and Services is subject to this Policy and the Terms of Use available at this link: https://forcebrands.com/terms. By using our Products and Services, you acknowledge that you have read and understand this Policy and the Terms and that you agree to all of their contents. Please note, this Policy does not extend to an employer’s use of your personal information where we are operating as a service provider on behalf of the employer (such as when you apply for a particular job posting). In that case, the employer’s privacy policy will apply.

We will occasionally update this Policy. When we do, we will revise the effective date above. Your continued use of our Products and Services after such changes means you accept the Policy as revised. We encourage you to periodically review this Policy to stay informed about how we collect and process your personal information.

(1) What We Collect and Process

What personal information we collect and process depends on how and why you interact with us.

Depending on the Products and Services you use, we may gather your name, address, ZIP code, email address, telephone number, password, credit card number, contact information, billing information, work history, and educational history (“account information”). We typically collect this information when you: (i) when you open an account; (ii) sign up to use a service; (iii) post a resume or profile; (iv) enter a contest; or (v) purchase a product. Sometimes we collect account information from third parties for purposes of providing our Products and Services, such as LinkedIn or third party recruiters. For more information on how we process information from resumes and profiles, see the “Resumes and Profiles” section below.

We may also request your age, demographic information, or favorites, or we may ask for descriptive, cultural, behavioral, preferential or lifestyle information about yourself (“profile information”). There are areas on the FORCEBRANDS Platform where you can submit feedback, such as success stories. (“feedback information”). It is up to you whether you wish to provide us with this information. For more information on how we handle particularly sensitive information (gender, race, or other protected status), see the “Restrictions On The Use of Sensitive Information” section below.

We also gather information about your use of our Products and Services, some of which could be considered personal information (“usage information”). The usage information we may collect typically includes the websites you visit and services you access, hardware and software information, IP address, browser type, domain names, access times and referring website addresses. We do not use this information to personally identify you. We use it to administer, operate, and improve our Products and Services. The process by which we collect this information is through cookies, pixels, tags, and similar online technologies. See our “ Cookies and Related Technologies” section below for more information.

(2) How and Why We Use Your Information

We generally use the information we gather to provide and improve the FORCEBRANDS Products and Services, establish and manage accounts, foster a positive user experience, deliver and secure our Products and Services, and otherwise achieve the purposes for which we provide specific notice at the time of collection . From time to time, we may also be required to use your information to: (i) perform accounting, auditing, billing, reconciliation, and collection activities; (ii) prevent, detect, identify, investigate, and respond to potential or actual claims, liabilities, prohibited behavior, and criminal activity; and (iii) comply with and enforce legal requirements, agreements, and policies.

If you are a Job Seeker, we may use your account and profile information to suggest potential executive recruiting opportunities to you. Where you have given us permission to do so, we may also use your information, including photos, as provided on your Job Seeker profile page, for promotions, marketing and advertisement purposes. We may also process your information (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third-party, or to determine your interest in receiving email or other communications about particular Products and Services.

For Employers, we may use your information, including photos, location, and logos, as provided on your Employer profile page, in the FORCEBRANDS Products and Services for promotions, marketing and advertisement purposes, pursuant to our Terms of Use.

For both Job Seekers and Employers, we may use information such as work history, industry, and location information to conduct analysis and market research, and to develop reports, white papers and related communications concerning the industry. Before we share any such reports, white papers, or communications with anyone else, we aggregate or deidentify the information so that they cannot reasonably be used to directly identify anyone.

We may use your information to inform you of other Products and Services available from us or our affiliated companies, or to contact you about your opinion of current Products and Services or potential new products and services that may be offered. Where you have provided consent, we may use your contact information in order to send you email or other communications (including phone calls or SMS Text messages) regarding updates to our Products and Services, potential executive job opportunities, surveys directed to you, and information on new opportunities and additional job postings that may be of interest to you. The nature and frequency of these messages will vary depending upon the information we have about you.

In addition, at the time of registration for an account on the FORCEBRANDS Platform, you have the option to elect to receive additional communications, information and promotions, including without limitation, newsletters from us relating to topics that may be of special interest to you, such as career management advice. If you have provided us with feedback information, we may use it for marketing purposes or to contact you for further information.

(3) Sharing Your Information

We may share personal information with the categories of parties listed below and as otherwise described in this Policy or at the time of collection:

  1. With third parties your consent or at your direction. For example, if you indicate that you would like to receive information about the opportunities, products or services of third parties at the time you register for an account, we supply your contact information to third parties (such as employers, recruiters, data aggregators, marketers or others) so they can communicate with you.
  2. With our service providers and vendors to help us perform and deliver our Products and Services, including: website and database hosting, management, and analytics; form processing; report generation and analysis; image processing; payment processing; information technology and security; communications; customer service; advertising and sponsorships; and auditing. These service providers and vendors typically have access to your personal information as necessary to perform their functions, and they may not share that information with any other third party.
  3. With the appropriate authorities (including legal, governmental, or judicial authorities) if legally required to do so, if requested to do so, or if we believe in good faith that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies, including investigations or preventive measures of activities that may violate our Terms of Use; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.
  4. With necessary third parties in connection with, or during negotiations for, an acquisition, merger, consolidation, asset sale, or similar business transfer that involves all or substantially all of our assets or functions where personal information is transferred or shared as part of the business assets. In addition, in the event we become the subject of a bankruptcy proceeding, whether voluntary or involuntary, we or our trustee in bankruptcy may sell, license or otherwise dispose of such information in a transaction approved by the bankruptcy court.

If you have an account with a profile on the FORCEBRANDS platform, other users or members of the platform may have access to limited profile information (e.g., name, industry); however, other users will not have access to your contact information, which is private by default.

(4) Restrictions On The Use of Sensitive Information

If you are a Job Seeker who applies for a position on or through the FORCEBRANDS Products and Services, you may be asked to provide information on your gender, race or other protected status where permitted by applicable law. Some employers are required by law to gather this information from job applicants for reporting and record-keeping requirements. Employers are required to use this information only in accordance with applicable law, and they cannot use it in making any negative employment decisions. Providing this information is strictly voluntary and you will not be subject to any adverse action or treatment if you choose not to provide this information.

(5) Resumes and Profiles

Personal information from resumes and profiles is handled as follows on the FORCEBRANDS platform:

  1. Registered Job Seekers may upload a limited number of resumes to their account. These resumes are stored in the FORCEBRANDS platform database. The information contained in these resumes is used for internal purposes and may be used by us to suggest employment matches or opportunities. This information is not accessible or searchable by potential Employers.
  2. Registered Job Seekers may choose to submit a new, or previously non-uploaded, resume in connection with an application to a specific job posting. These resumes are stored in the FORCEBRANDS platform database. The information contained in these resumes is used for internal purposes, and may be used by us to suggest employment matches or opportunities. The information from these resumes is provided to the Employer, and is accessible or searchable by potential Employers. FORCEBRANDS provides or shares resumes with a potential Employer when the Job Seeker completes an electronic release through the platform. FORCEBRANDS is not responsible for the Employer’s or any third party’s use of these resumes.
(6) Public Areas of the Platform

Please remember that if you post any of your personal information in public areas of the FORCEBRANDS platform, such as in online forums or chat rooms, such information may be collected and used by others over whom we have no control. We are not responsible for the use made by third parties of information you post or otherwise make available in the public areas of the platform.

(7) Cookies And Related Technologies

As noted above, we collect information about your device, browsing actions, and patterns when you visit our FORCEBRANDS Products and Service through cookies and related online technologies like pixels, tags, and web beacons. When you access our Products and Services, including our online platform, our servers log your IP Address and sometimes your domain name. Our server may also record the referring page that linked you to us (e.g., another web site or a search engine); date and time stamp of your visit; operating system; the pages you visit on this website and the files you interact with; the website you visit after this website; the ads you see and/or click on; other information about the type of web browser, computer, Products and Services used, related software and settings you are using; any search terms you have entered on our website(s) or a referral site; and other web usage activity and data logged by our web servers. We use this information for internal system administration, to help diagnose problems with our server, and to administer our websites. We may also use this information to improve the quality of our Products and Services, store user preferences, track user trends, and to gather demographic information, such as country of origin and Internet Service Provider.

In order for these technologies to work, third parties collect and/or receive information from our websites and elsewhere on the internet. These third parties typically collect information in the aggregate and in a way that does not personally identify you. As explained in “Links To Other Websites,” we do not control all of the information collected by such third parties in connection with our websites, and they do not process all such data on our behalf. You may opt-out of some of these technologies, but if you do, the functionality of our website or online services may be impacted.

There are different types of cookies which are used to do different things, such as letting you navigate between different pages on a website efficiently, remembering preferences you have given, and helping us to identify ways to improve your overall site experience. Among other third-party cookies, we use Google Analytics. Your use of the FORCEBRANDS Platform and Services constitutes your consent to the Platform and Services settling cookies on your computer or device. You can prevent or restrict the storage of cookies on your computer or device by setting your browser not to accept cookies or to request your permission before setting cookies.

Web beacons (sometimes called single-pixel gifs) allow us to count users who have visited those pages and compile aggregated statistics about our Web site usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides. You may not decline web beacons; however, they can be rendered ineffective by declining all cookies or modifying your browser settings to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. Third parties are not permitted to use web beacons on FORCEBRANDS Products and Services.

Our site may also include social media features and widgets, connecting your social media accounts to your experience. Your interactions with these features are governed by the privacy policy of the company providing it.

We do not process or respond to your browsers’ “do not track” signals. You may, however, disable certain tracking as discussed above (e.g., by disabling cookies). (8) Your Choices and Rights

You may choose not to send us certain personal information. We will tell you what information is required to use the Products and Services when you create or modify your account.

You may review, correct, update or change your account on the FORCEBRANDS platform at any time.

You may choose not to receive marketing communications from us by clicking on the unsubscribe link in our marketing emails or by contacting us as at privacy@forcebrands.com, or by following the instructions in the email or text message you receive, if that feature is made available for you. If you provide us with inconsistent privacy preferences (for example, by indicating on one occasion that we may provide you with marketing offers and on another occasion that we may not), we will treat it as if you opted out to receive our marketing communications.

You can close your FORCEBRANDS platform account at any time, in which event we will mark your account as closed and limit access to your information and resumes to FORCEBRANDS personnel only. Your uploaded or saved resumes will remain in our resume database and will not be deleted unless you instruct us to do so.

You can also choose to tell us that you no longer wish to have your information retained by FORCEBRANDS.

(9) Protecting Your Personal Information

While no one can guarantee your personal information is completely secure at all times, we use administrative, organizational, technical, and physical safeguards to protect the personal information we collect and process. Our security controls are designed to maintain data confidentiality and integrity, and give us appropriate access to your data.

Among other things, we use professional third party service providers and data centers to provide our Products and Services, and enter into confidentiality agreements with them where appropriate. Those data centers implement industry-standard measures to protect the security of the personal information we collect. For example, those service providers and data centers use SSL (Secure Socket Layers), firewalls, and digital certificates to help protect your personal information. Passwords created by you for use on our platform are encrypted. The financial partners we use that collect and process payment information follow the Payment Card Industry Data Security Standard.

(10) Links to Other Websites

The FORCEBRANDS Products and Services contain links to other websites over which we have no control. We are not responsible for the privacy policies or practices of other websites to which you choose to link from our Sites. We encourage you to review the privacy policies of those other websites so you can understand how they collect, use and share your information.

California Residents:

If you are a California resident, please note that we do not share information that identifies you personally with non-affiliated third parties for their own marketing use without your permission.
